Terms of Service
Effective September 14, 2026
1. Who we are and what you are agreeing to
These Terms of Service (“Terms”) govern your use of the website and application at probateplan.store (“ProbatePlan”, “we”, “us”). By signing in to a plan, or otherwise using ProbatePlan, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use ProbatePlan.
2. What ProbatePlan is — and is not
ProbatePlan is an organizing tool. It gives a family a shared, private place to record facts about an estate, list assets and debts, keep documents together, track deadlines and tasks, and record what the participants have agreed among themselves.
ProbatePlan is not a law firm and does not provide legal advice. Specifically:
- No content in ProbatePlan — including the reference guide, the help text beside questions and columns, deadline calculations, starter lists, or any summary or figure the software produces — is legal advice, and none of it is tailored to your estate. It is general information that may be incomplete, out of date, or inapplicable where you live.
- Nothing created in ProbatePlan is a legal document. A plan, an approval, a sign-off, or an exported PDF is a record of a family's shared understanding for coordination purposes only. It is not a will, trust, court filing, inventory accepted by a court, contract of distribution, release, or waiver of any person's rights in an estate.
- Using ProbatePlan does not create an attorney-client relationship with us or with anyone.
- Probate law and procedure differ by state and by county and change over time. You must confirm anything you intend to rely on with the probate court having jurisdiction and with an attorney licensed in your state.
3. Accounts and access
Access to a plan is by invitation from the person administering that plan. You must be at least 18 years old. You are responsible for keeping your sign-in links and any password private, for signing out on shared devices, and for everything done under your account. Tell the plan administrator or us promptly if you believe your access has been misused.
Each plan has an administrator who can add and remove participants and set their roles. The administrator, not ProbatePlan, decides who is in a plan.
4. Your content
Everything you and your fellow participants enter or upload — answers, figures, notes, documents, approvals — is your content. You keep whatever rights you have in it. You give us only the permission needed to store it, show it to the other participants in your plan, generate exports from it, and otherwise operate the service.
You are responsible for your content. In particular you agree that:
- You have the right to enter and upload it, including any information about other people (a decedent, heirs, creditors, institutions).
- You will not upload anything unlawful, or anything that infringes someone else's rights.
- Accuracy is up to you. ProbatePlan does not verify figures, documents or answers, and an approval recorded in a plan means only that the participant reviewed that version of the plan.
5. Acceptable use
Do not use ProbatePlan to break the law, to access a plan you have not been invited into, to probe or disrupt the service, to upload malicious files, or to harvest information about other participants. We may suspend access that we reasonably believe threatens the service or other users.
6. Availability, backups and changes
We work to keep ProbatePlan available and to keep your content safe, but we do not guarantee uninterrupted service or that data will never be lost. Export your plan (CSV and PDF exports are built in) at milestones and keep your own copies of important documents. We may change, add or remove features, and may discontinue the service with reasonable notice, during which you will be able to export your content.
7. Ending your use
A plan administrator can remove any participant, and you can stop using ProbatePlan at any time. To have a plan and its content deleted, contact us at support@probateplan.store; we will confirm the request with the plan administrator before acting on it, because the content belongs to the family, not to any one participant.
8. Disclaimer of warranties
ProbatePlan is provided “as is” and “as available”, without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the service, the reference material, or any calculation will be correct, complete, current, or suitable for your situation.
9. Limitation of liability
To the fullest extent permitted by law, ProbatePlan and the people who build and run it will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, missed deadline, court outcome, tax consequence, or financial loss, arising from your use of or inability to use the service or from reliance on anything in it. Our total liability for any claim relating to ProbatePlan will not exceed the greater of the amount you paid us in the twelve months before the claim (which may be nothing) or fifty US dollars. Some jurisdictions do not allow certain limitations; in those places these limits apply to the extent permitted.
10. Attorney referrals
Participants may opt in, under Account, to be contacted by a probate attorney licensed in their state. This is optional and off by default. What is shared, and how to withdraw, is described in the Privacy Policy. Any attorney who contacts you is independent of ProbatePlan; we do not vouch for their advice, and any engagement is between you and them.
11. Governing law
These Terms are governed by the laws of the State of Washington, United States, without regard to its conflict-of-law rules. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Washington, and you consent to their jurisdiction.
12. Changes to these Terms
We may update these Terms. The effective date at the top will change, and for material changes we will notify participants by email or a notice in the application. Continuing to use ProbatePlan after a change means you accept the updated Terms.
